Nelson for Part 3 of the ABA Section of Real Property, Trust and Estate Law 's series on “Asset Protection Trusts.” Our presentation made the case that asset protection planning is rarely one-size-fits-all, the right approach depends on the client's objectives and domicile. We covered four categories of trust planning: Domestic Asset Protection Trusts (DAPTs), inter vivos QTIP trusts, Spousal Lifetime Access Trusts (SLATs), and third-party created multi-generational trusts, built around a central point: governing-law selection, not just the trust form, drives the actual outcome. For Florida residents specifically, we walked through a pyramid of techniques ranked by reliability: homestead protection and exempt assets at the top, followed by third-party trusts and spousal transfers, with DAPTs at the bottom as a tool of last resort rather than a first move. Only 21 states authorize DAPTs, but meaningful creditor protection is still very achievable for Florida clients through QTIPs, SLATs, and well-situated third-party trusts such as dynasty trusts, often layered together rather than relied on individually. A theme ran through nearly every case we discussed, from DAPT challenges to disputes over trusts created for children and grandchildren: courts look closely at what a settlor actually does after a trust is funded, not just what the trust document says. Retained control, not drafting language, is what tends to decide these cases. We also discussed why the timing matters: the One, Big, Beautiful Bill Act permanently raised the federal Basic Exclusion Amount to $15 million (single) / $30 million (married), inflation-adjusted for 2026, a strong window for married clients to combine asset protection with transfer-tax planning while exemption levels remain this high. Our closing message for clients: address asset protection planning even for a portion of net worth, because once rich, don't get poor. Total residential sales in Miami-Dade County fell 10.7% from a year earlier to 1,788 transactions, according to data from the Miami Association of Realtors. Single-family deals slid 8.2% while condo sales dropped 13%, reflecting both the drag of elevated mortgage rates and limited financing options for older condominium buildings. Despite the slowdown, Miami's long-term growth story remains intact. Condominium prices have more than doubled over the past decade, and single-family values have climbed 150% over the same period. In August, single-family prices continued their 13-year streak of near-uninterrupted gains, while condo values edged slightly lower. Foreign capital continues to play an outsized role. Nearly half of all new construction and condo conversion sales in South Florida over the past 18 months went to international buyers, according to Miami Realtors' first global new-construction sales report. The study, covering more than 9,000 units across 37 projects, underscores Miami's enduring pull as a global investment hub. Inventory is expanding but remains constrained compared with pre-pandemic levels. Active listings rose 26% year-over-year in August, yet total supply is still 16.6% below 2019. Single-family homes now carry 6.4 months of supply, indicating balance between buyers and sellers, while condominiums sit in buyer's market territory at 14 months. New listings, however, are declining, suggesting the growth in available supply may prove temporary. Market fundamentals remain healthy. On the flip side, over the past few years as the housing market has moved through a cyclical cooling phase, the deceleration in net domestic migration across many Texas and Florida markets has contributed to larger demand shocks, and greater upticks in active inventory and weaker home price dynamics—with some pockets of both states even experiencing outright price corrections. That’s normal: cyclical cooling tends to hit high-growth markets harder on the downside. Looking ahead, Texas and Florida will continue to be among the top destinations for domestic movers. They’re simply moving through a softer window right now, in part because of the migration pull-forward that occurred in 2021–2022 (many of those households likely would have moved in 2023–2025 anyway), and because switching costs remain exceptionally high in the current housing cycle. For example, some homeowners in states like Illinois who might have otherwise sold in 2023-2026 and relocated to Florida are staying put, as taking on a materially higher mortgage rate/monthly payment is simply too difficult to justify right now.
